This Fragrance Festival November, 2023 Plan (Fragrance Festival Plan) and made available on www.youvora.com and its mobile application/site thereof (collectively, "youvora.com") by COSMIX RETAIL (A UNIT OF SK NASIRUDDIN BIRI MERCHANTS PRIVATE LIMITED),
Please read these terms and conditions before entering the Campaign. You agree that, by participating in this campaign, you will be bound by these Terms and Conditions and you acknowledge that you satisfy all Campaign eligibility requirements as provided herein below.
For the purposes of these Terms and Conditions, wherever the context so requires "You" or "Your" shall mean any natural person who is a participant in the Campaign and "We" or "Our" shall mean youvora.com.
ELIGIBILITY:
You need to fulfil the following eligibility criteria to participate the Campaign:
(a) You should be an individual legal resident of the Republic of India;
(b) You should have set India as your current country in your account settings on youvora.com;
(c) You should have a billing address within the territory of India; and
(d) You should be of an age of 18 years or older at the time of entry into the Campaign.
Our employees, their immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren), and our affiliates, advisors, advertising/promotion agencies are not eligible to enter the Campaign.
DETAILS OF THE CAMPAIGN AND HOW TO ENTER:
This Campaign will commence from November, 1, 2023 at 12:00:01 a.m. (IST) and end on November, 15, 2023 at 11:59:59 p.m. (IST) ("Campaign Period").
In order to participate in the Campaign, during the Campaign Period, you must:
a. Sign-in to or sign-up from your youvora.com account;
b. Purchase perfumes worth a minimum value of INR 1200/-
c. At the end of the period of the Campaign, amongst all the participants who fulfil the criteria mentioned in Clause (b) above for the transactions during the Campaign Period, winners will be selected by way of a random draw of lots as under:
(i) Customers who buy perfumes worth Rs. 1200/- or more will be eligible for the lucky draw from which (a) 5 (three) lucky winners will each get a 1g Gold Coin (c) All purchases above Rs. 1200/- would be entitled to assured gift worth Rs. 399/-.
(ii) That during the campaign period there be Site wide 30% off across all brands.
At the end of the Campaign Period, a randomiser event will be held on social media to declare the winners.
Please note that we may be running similar campaigns or promotions at the same time as this Campaign. By participating in the present Campaign, you will not be eligible to receive any benefit or prize awarded in any other promotion/ campaign unless you enter each promotion/ campaign separately.
PRIZE DRAWING:
The drawing for selection of the winners of the Campaign will be at the end of the Campaign Period. We will notify the selected participants by e-mail following the draw, and they will be required to share a valid proof of identity and age in the form of a copy of PAN Card / Driving License / Voter ID / Indian passport to be eligible to claim the Prize. A PAN card copy is mandatory for prizes worth INR 10,000 or more. The selected participants will automatically forfeit their claim to the Prize if they do not meet the eligibility criteria or do not comply with these Terms and Conditions. Each Prize will be awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). There are no cash or other prize alternatives available in whole or in part. However, in circumstances beyond our control, we may substitute a similar alternative prize of equal or greater value in our sole discretion. If any selected participant does not respond back to any communications sent in relation to the Campaign within the time period communicated by youvora.com and/or does not provide the requisite documentation required for claiming the Prize he/she shall not be eligible to be declared winner of the Prize. The selected participant will also be required to prove his/her age, failing which he/she will be disqualified from the Campaign offer. In such cases, another participant who fulfilled the eligibility criteria mentioned above of the 'Details of the Contest and How to Enter' section above, will be selected as winner by way of a random draw of lots and shall be eligible to win the Prize.
ADDITIONAL TERMS:
We may, to the maximum extent permitted by applicable law and in our sole discretion, change the Terms and Conditions or cancel the Campaign at any time; or modify, terminate, or suspend the Campaign should viruses, worms, bugs, unauthorized human intervention or other causes beyond our control corrupt or impair the administration, security, fairness or proper play of the Campaign or submission of entries.
We are not responsible for: (a) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by you or by any of the equipment or programming associated with or utilized in the Campaign, or by any technical or human error that may occur in the processing of entries; (b) any printing or typographical errors in any materials associated with the Campaign; (c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (d) injury or damage to your or any other computer or mobile resulting from downloading any materials in connection with the Campaign.
We may, in our sole discretion, disqualify any individual found to be: (a) tampering with the entry process or the operation of the Campaign or website or mobile application; (b) acting in violation of these Terms and Conditions; or (c) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.
If your participation is by using robotic, automatic, programmed or similar entry methods, your entry will be void. The authorized subscriber of the e-mail account used to enter the Campaign at the actual time of entry will be deemed to be the participant and must comply with these Terms and Conditions in the event of a dispute as to entries submitted by multiple users having the same e-mail account. The authorized account subscriber is the natural person who is assigned an e-mail address by an internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domains associated with the submitted e-mail addresses. No benefits greater than those described in the "Description of the Campaign and How to Enter" section above in these Terms and Conditions will be awarded.
MISCELLANEOUS:
The Campaign and all accompanying Fragrance Festival Plan by youvora.com, or its affiliates. All rights reserved. No requests for transfer or assignment or redemption of the benefits shall be entertained. You agree that all our decisions related to the Campaign are final and binding. Failure by youvora.com to enforce any of these Terms and Conditions in any instance shall not be deemed to be a waiver of the Terms and Conditions and shall not give rise to any claim by any person. These Terms and Conditions are subject to Indian laws and the courts at Kolkata shall have the exclusive jurisdiction in respect of any disputes or any matter arising here from.
FORCE MAJEURE
This Campaign is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, act of God or any circumstance beyond the reasonable control of youvora.com ("Force Majeure Event"). Youvora.com shall be not liable for any delay or adverse effect caused to the participants in the Campaign including the winners as a result of a Force Majeure Event.
PUBLICITY RELEASE:
By participating in the Campaign, you give youvora.com and/ or its affiliates permission to use your name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, taken or made in relation to the Campaign and any promotions, events, or Campaign to follow. You agree that youvora.com and/ or its/their affiliates have the right to publish your saved item details for any communication, promotions, events, or contests that follow. You agree that youvora.com and/ or its/their affiliates have complete ownership of such pictures, etc., including the entire copyright, and may use them for any purpose. These uses include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, advertisements, and any promotional or educational materials in any medium now known or later developed, including the internet. You acknowledge that you will not receive any compensation, etc. for the use of such pictures, etc., and hereby release youvora.com and/ or its/their affiliates and its agents and assigns from any and all claims which arise out of or are in any way connected with such use. You give your consent to youvora.com and/or its/their affiliates, agents and assigns to use your name and likeness to promote the Campaign and any promotions, events, or contests to follow.
LIABILITY RELEASE:
This Campaign is being made purely on a "best effort" basis and participating in this Campaign is voluntary. By participating in the Campaign, you will be legally bound hereby, to release from liability, and hold harmless youvora.com and any of its/their affiliates, employees or agents representing or related to youvora.com and its/their services/products. This release is for any and all liability for personal injuries (including death), property loss or damage, and misuse of the benefits/ Prizes offered under this Campaign, in connection with any activity or directly or indirectly, by reason of the acceptance, possession, or participation in the Campaign, even if caused or contributed to by our negligence.
WINNER ANNOUNCEMENT:
After we confirm the winner, we will post the winner's names on the Social Media as per the Campaign Schedule.
